304.1 – General

Elevators and conveyingsystems shall be maintained in a safe condition and in accordance with ASMEA17.1, as modified by Appendix K of the New York city building code. Every newand existing elevator or conveying system shall be inspected and tested inaccordance with this article.

304.2 – Elevators,Escalators, Moving Walkways, Material Lifts, Man Lifts and Dumbwaiters

Elevators, escalators,moving walkways, mate- rial lifts, man lifts and dumbwaiters shall be inspectedand tested in accordance with the schedule set forth in Table N1 of ASME 17.1as referenced in chapter 35 and as modified in chapter 30 and appendix K of theNew York city building code (Table N1).

Exception: Elevators locatedin one-family, two-family or multiple-family dwellings that service only asingle owner-occupied dwelling unit which is not occupied by boarders, roomersor lodgers, and elevators located within convents and rectories that are notopen to non-occupants on a regular basis are not subject to periodic inspectionrequirement of such reference standard. Inspections and tests shall beperformed in accordance with Table N1.

304.6.1 – Inspection andTesting Entities

The required periodicinspections in Table N1 shall be made by the department. The other tests and inspectionsin Table N1 shall be performed on behalf of the owner by an approved agency inaccordance with this code and department rules. Where indicated in Table N1,tests and inspections shall be witnessed by an approved agency not affiliatedwith the agency performing the test. Not affiliated, as used in this section,shall mean the approved agency owners, directors and inspectors shall beindependent of all relative approved agencies, maintenance firms or otherentities providing any associated services to the device owner. Such othertests and inspections shall comply with the timeframes established as follows:

1). Category 1 inspectionsand tests shall be performed between January 1st and December 31st of each yearat a minimal time interval of six months from the date of the previous Category1 testing. Category 1 tests are required on new installations the calendar yearfollowing final acceptance test.

2). Category 3 inspectionsand tests for water hydraulics shall be performed every three years on orbefore the anniversary month of the last Category 3 testing.

3). Category 5 inspectionsand tests shall be performed every five years on or before the month of thefinal acceptance test for new elevators or the anniversary month of the lastCategory 5 testing.

The department shall benotified by the performing agency at least seven days prior to the Category 1testing of escalators, Category 3 testing of water hydraulic elevators andCategory 5 testing of elevators pursuant to the rules of the department.

The performing agency shall notify the department by telephone,electronically or in writing within 24 hours.

(ii) providea copy of such report to the owner or owner’s representative; and

(iii) affix the inspection dateand his or her signature over a stamp identifying his or her approved agencyand his or her approval number on the inspection certificate issued by thedepartment attesting to the completion of items (i) and (ii).

304.6.4.2 – When aWitnessing Agency Is Required

When a witnessing agency isrequired to witness inspections and tests under Table N1, the performinginspector shall, on the day of each inspection and test complete the fieldinspection and test report, documenting all violating conditions, if any, and affixhis or her signature. The witnessing agency inspector shall, on the day of eachinspection and test:

(i)   reviewand confirm the field inspection report and also affix his or her signature toit;

(ii) providea copy of such report to the owner or owner’s representative; and

(iii)  (iii) affix the inspectiondate and his or her signature over a stamp identifying his or her approvedagency and his or her approval number on the inspection certificate issued bythe department attesting to the completion of items (i) and (ii).

304.6.5 – Inspection and TestReports Submission

Inspection and test reportsshall be submitted to the department on such forms and in such manner asrequired by the commissioner. Such reports shall comply with the following anddepartment rules:

1. The inspection and testreports shall contain signatures of (i) the performing agency inspector anddirector, (ii) the witnessing agency inspector and director, and (iii) thebuilding owner.

2. The completed inspectionand test reports, with all applicable signatures, shall be delivered to theowner by the approved performing and/or witnessing agency within 30 days of thetest listing all violating conditions for each device tested, and filed withthe department within 60 days after the date of the test by the owner or itsauthorized designee.

Exception: Inspection andtest reports are not required to be submitted to the department for privateresidence wheelchair lifts and private residence dumbwaiters devices. However,the owner shall maintain an inspection and test log to be available to thedepartment upon request.

All defects as found in suchinspection and test reports shall be corrected within 120 days after the dateof inspection and test, except all hazardous conditions shall be correctedimmediately. An affirmation of correction shall be filed within 60 days of thedate of correction.

304.7 – Required Contract

The owner of all new andexisting passenger elevators and escalators shall have acontract with anapproved agency to perform elevator and escalator maintenance, repair andreplacement work as defined by ASME A17.1 as modified by Chapter K1 of AppendixK of the New York city building code. The name, address and telephone number ofsuch agency shall be maintained at each premises, on the mainline disconnectswitch and in a location readily accessible to employees of the department andto maintenance and custodial staff at the premises.

When all elevators servicing a building or any section of abuilding are expected to be out of service for less than two hours, or are outof service as the result of emergency work, notice is not required to beposted, except that where such outage lasts for two or more hours, notice shallbe posted as soon as practicable after the commencement of such service outage.
